Terms & Conditions

Effective Date: 27 July 2026

1. Agreement

These Terms and Conditions govern the supply of photography, videography, drone imaging, floor plans, virtual tours and related services provided by Lightspeed Photography (“we”, “our”, “us”) to our clients (“you”, “your”).

By requesting a quotation, making a booking, purchasing our services or accepting delivery of any media, you acknowledge that you have read, understood and agree to these Terms and Conditions.


2. Services

Lightspeed Photography provides professional services including, but not limited to:

  • Real Estate Photography
  • Commercial Photography
  • Industrial Photography
  • Drone Photography and Videography
  • Floor Plans
  • Virtual Tours
  • 3D Property Capture
  • Construction Progress Photography
  • Asset Documentation
  • Marketing Photography
  • Image Editing Services

3. Quotations

All quotations are valid for thirty (30) days unless otherwise stated.

Quoted prices are based on the information provided at the time of quotation. Additional work outside the quoted scope may incur additional charges.


4. Bookings

Bookings are subject to availability.

Lightspeed Photography reserves the right to reschedule appointments due to weather, safety concerns, equipment failure, airspace restrictions, illness or circumstances beyond our reasonable control.


5. Payment

Payment is due in accordance with the invoice issued unless otherwise agreed in writing.

Online payments are securely processed through Stripe.

Completed work remains the property of Lightspeed Photography until payment has been received in full.

Late payments may incur reasonable recovery costs where permitted by law.


6. Copyright

Unless otherwise agreed in writing:

All photographs, videos, drone imagery, floor plans and other media created by Lightspeed Photography remain the intellectual property and copyright of Lightspeed Photography.

Payment for photographic services does not transfer copyright ownership.

Copyright is protected under the Copyright Act 1968 (Cth).


7. Licence to Use Images

Upon full payment, Lightspeed Photography grants the Client a non-exclusive, non-transferable, revocable licence to use the supplied media solely for the purpose for which it was commissioned.

Permitted uses include:

  • Marketing a property for sale.
  • Marketing a property for lease.
  • Advertising a commercial property.
  • Promoting a business.
  • A specific advertising campaign.
  • A specific marketing campaign.

The licence automatically expires when:

  • the property is sold;
  • the property is leased;
  • the property is withdrawn from the market; or
  • the associated marketing campaign has concluded,

whichever occurs first.

Following expiry of the licence, the supplied media must not be reused, republished or distributed without the prior written consent of Lightspeed Photography.

Continued use may require the purchase of a new licence.


8. Re-listing of Property

If a property is marketed again after the original campaign has ended, whether by:

  • the same client;
  • another real estate agency;
  • the property owner; or
  • any third party,

a new licence must be obtained from Lightspeed Photography before previously supplied images may be reused.

Previous payment does not constitute a perpetual or ongoing licence.


9. Third Party Use

Images supplied by Lightspeed Photography may not be supplied to, licensed to or used by another party without prior written permission.

This includes, but is not limited to:

  • Real Estate Agencies
  • Builders
  • Architects
  • Interior Designers
  • Marketing Agencies
  • Developers
  • Publishers
  • Contractors

Separate commercial licensing is available upon request.


10. Artificial Intelligence (AI)

The Client must not upload, distribute, sell, licence or otherwise provide any media supplied by Lightspeed Photography for the purpose of training or improving:

  • Artificial Intelligence (AI)
  • Machine Learning
  • Computer Vision
  • Image Generation Systems
  • Large Language Models

without prior written permission from Lightspeed Photography.

The Client must not substantially alter supplied media using AI or other automated editing technologies in a manner that:

  • Misrepresents the original work;
  • Attributes altered work to Lightspeed Photography;
  • Creates misleading or deceptive representations of the photographed property, business or subject.

11. Drone Operations

All drone operations are conducted in accordance with applicable Australian aviation legislation and Civil Aviation Safety Authority (CASA) requirements.

Flights may be delayed, modified or cancelled due to:

  • Weather;
  • Temporary restricted airspace;
  • Safety considerations;
  • Regulatory requirements.

Safety always takes priority.


12. Client Responsibilities

The Client is responsible for ensuring:

  • Safe site access;
  • Property readiness;
  • Access permissions;
  • Permission from the property owner where required;
  • Accurate information supplied during booking.

13. Portfolio & Promotional Use

Unless otherwise agreed in writing prior to the photographic session, the Client grants Lightspeed Photography permission to use photographs, videos, drone imagery, floor plans and other commissioned media for promoting Lightspeed Photography and its professional services.

This includes:

  • Website;
  • Social Media;
  • Online Portfolio;
  • Printed Portfolio;
  • Marketing and Advertising Material;
  • Industry Awards;
  • Photography Competitions;
  • Professional Publications;
  • Client Presentations and Business Proposals.

Where practical, Lightspeed Photography will not disclose confidential information, sensitive business information, personal information or property addresses without prior consent.

If the Client requires complete confidentiality or does not wish commissioned work to be used for promotional purposes, they must notify Lightspeed Photography in writing before the photographic session commences.


14. Confidentiality

Where requested by the Client, Lightspeed Photography will treat confidential commercial information as confidential and will not disclose or publish such information without prior written consent, except where required by law.


15. Image Storage

Lightspeed Photography will make reasonable efforts to retain original image files after delivery.

Clients are strongly encouraged to download and maintain their own backup copies.

Permanent archival storage is not guaranteed.


16. Cancellations

Bookings cancelled with reasonable notice may be rescheduled.

Where work has commenced, cancellation fees may apply.


17. Limitation of Liability

While every reasonable effort is made to provide high-quality professional services, Lightspeed Photography shall not be liable for indirect, consequential or economic loss arising from the use of supplied media.

Liability is limited to the value of the services supplied, to the maximum extent permitted by law.

Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.


18. Privacy

Personal information is handled in accordance with the Lightspeed Photography Privacy Policy.

Payment information is processed securely through Stripe.

Lightspeed Photography does not store customers’ full credit card details.


19. Changes to these Terms

Lightspeed Photography may update these Terms and Conditions from time to time to reflect changes in our services, legal requirements or business practices.

The latest version will always be published on our website.

Continued use of our services after any update constitutes acceptance of the revised Terms.


20. Governing Law

These Terms and Conditions are governed by the laws of Western Australia and the Commonwealth of Australia.

Any disputes shall be subject to the exclusive jurisdiction of the Courts of Western Australia.
